The PTI leader was taken to Judicial Magistrate Waqas Ahmed Raja’s court after a district and sessions court accepted Islamabad Police’s petition overturning a decision that sent Fawad on judicial remand and rejected his plea to have him discharged from the sedition case.
A case against Fawad was filed at the Kohsar Police Station on Wednesday, which led to his arrest from his Lahore residence. As a result of the media talk that he gave, he is facing sedition charges for publicly “threatening” Election Commission of Pakistan (ECP) members.
In court on Friday, the prosecution requested an extension of his physical remand, but Judicial Magistrate Waqas Ahmed Raja denied the request. Later, the session court reversed the decision.
According to PTI lawyer Babar Awan, the “tactics” used against Fawad constitute “state terrorism” and the session judge has limited authority to review a court decision. It is the magistrate’s responsibility to impose physical and judicial remand. The Sessions Court cannot impose physical remand.
“Fawad is real, not fake,” Awan said as the prosecution repeatedly requested photogrammetric proof.
Fawad Chaudhary’s brother also claimed that the PTI leader’s cellphone had been seized.
“What was the point of taking the phone?” The statement was made by Fawad — who has already owned his assertions,” Faisal, a lawyer, said.
Awan also slammed the session judge’s decision, claiming that it was rushed.
